StudyHertz Terms of Service

Version 1.1 — Effective October 27, 2026

These Terms are an agreement between you and Alaric Hartsock, an individual in Bend, Oregon ("we," "us"), who runs StudyHertz at studyhertz.com (the "Service"). By checking the box at sign-up, or by using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you don't agree, don't use the Service.

1. Who can use StudyHertz

You must be at least 13 years old. If you're under 18, or under the age of majority where you live, a parent or guardian must agree to these Terms for you. You can't use the Service if the law or a previous termination by us bars you from it.

2. Your account

You can sign up with a username and password, or sign in with Apple, Google, GitHub, or Microsoft. Keep your login secure. You're responsible for what happens under your account. Tell us right away if you think someone else has accessed it. Your use of a sign-in provider is also covered by that provider's own terms.

3. What the Service is and isn't

StudyHertz helps you log study sessions, goals, exams, to-dos, and achievements. It's a productivity tool, not professional advice. We don't promise any score, grade, admission, licensing result, or outcome on the MCAT or any other test or application. StudyHertz isn't affiliated with or endorsed by the AAMC or any school or testing body. Nothing in the Service is medical, mental health, educational, or admissions advice. Please take breaks and look after your health.

4. Your content

Everything you enter, such as session logs, goals, notes, and bug reports, is "Your Content," and you keep ownership of it. You give us a limited, non-exclusive license to host, store, process, back up, and display Your Content, but only to run, secure, and improve the Service. If you send a bug report or feedback, we may use the ideas in it without paying you or owing you anything. Don't include sensitive personal information, such as health details, in bug reports.

5. Acceptable use

You agree not to:

6. Open source software

The StudyHertz source code is licensed under the GNU General Public License v3.0 or later (GPL). That license, not these Terms, controls what you can do with the code, including copying, modifying, and running your own copy. Nothing in these Terms limits your rights under the GPL. These Terms cover only your use of our hosted Service at studyhertz.com: your account, your data, and our servers. The name "StudyHertz" and its logos aren't licensed under the GPL. If you run a modified version, please give it a different name so people don't confuse it with the official Service.

7. Free trial, subscriptions and refunds

Free trial. Every new account gets a 30-day free trial that starts when you sign up. No payment card is needed for the trial, and it doesn't turn into a paid plan on its own. Accounts created before October 28, 2026 keep free access.

Plans and price. After the trial you can subscribe for US$4.99 per month or US$39 per year, plus any tax that applies. We show the price and billing period before you pay. Payments are handled by Stripe; we never see or store your full card number.

Automatic renewal. A subscription renews automatically at the end of each billing period (monthly or yearly) and is charged to your saved payment method at the then-current price until you cancel. We'll tell you about any price change at least 30 days in advance, and it applies from your next renewal.

Cancelling. You can cancel any time in Settings → Subscription → Manage subscription. Cancelling stops future renewals; you keep paid access until the end of the period you've already paid for.

Refunds. Except where the law requires otherwise, payments are not refundable and we don't give credit for partial periods. If you were charged by mistake or forgot to cancel, email support@studyhertz.com within 14 days of the charge and we'll review it in good faith.

If you don't subscribe or a payment fails. When the trial ends without a subscription, or a subscription ends after failed payment retries, your account becomes read-only: you can still sign in, view and export your data, but you can't add new entries. We don't delete your data because you stop paying.

8. Privacy and cookies

Our Privacy Policy explains what data we collect and how we use it, including cookies and Google Ads, which load only after you consent.

9. Changes to the Service and these Terms

We may change, pause, or discontinue any part of the Service. If we make a material change to these Terms, we'll notify you in the app or by email at least 14 days before it takes effect, except when the change is required by law or for security. In that case it may take effect sooner. If you keep using the Service after the effective date, or accept the new Terms when we ask you to, that means you agree to them. If you don't agree, stop using the Service and delete your account.

10. Termination

You can delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we shut down the Service. When we can, we'll give notice and a reasonable chance to export your data. After your account is deleted, we'll delete Your Content within a reasonable time, except for anything we must keep by law or that remains in backups until they rotate out. Sections 4 (feedback), 6, and 11 through 14 survive termination.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DATA WILL NEVER BE LOST. Please keep your own backups of anything important.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR LOST OPPORTUNITIES (INCLUDING EXAM OR ADMISSIONS RESULTS). OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF (A) WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) US $50. Some places don't allow these limits, so they may not apply to you. Nothing here limits liability for fraud, gross negligence, willful misconduct, or anything else that can't be limited by law.

13. Indemnity and security reports

If your misuse of the Service or your violation of these Terms leads to a claim against us, you agree to cover our reasonable costs, including attorney fees. You can report security issues to security@studyhertz.com. If you act in good faith and avoid harming users or their data, we won't take legal action against you for that research.

14. Governing law and disputes

These Terms are governed by Oregon law, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Deschutes County, Oregon, and both sides consent to those courts. Either side may also bring a claim in small claims court. If you're a consumer in a place whose law gives you the right to sue in your home courts or under your local law, nothing here takes that right away. Before filing a claim, please contact us and try to resolve it informally for 30 days.

15. General

These Terms, together with the Privacy Policy, are the entire agreement between us. If any part is found unenforceable, the rest stays in effect. If we don't enforce a provision, that doesn't waive it. You can't transfer these Terms without our consent. We may transfer them if the Service is sold or moved to a company we form. We may send notices in the app or to the email linked to your account.
